White settler colonial wars, white supremacy, segregation,

parts of Texas' historical, colonial legacy and its founda-
tion. The modern-day opponents of "CRITICAL RACE THEORY,"
is a fascist movement of continuation of modern-day neo- colonial structures, in teaching falsehoods to school children and its citizenry, in order to bury this ugly, war criminal history to live in lies. Prison slaves, including juvenile children detained at its State Juvenile Youth Council school in Gatesville, TX. were "leased out" to work on local frams and to build the state capitol mansions and buildings in Austin, TX. Recently, while preparing the land to build a new FORT BEND SCHOOL NEAR THE OLD Imperial Sugar Company near the old Central prison unit, near Sugarland, TX., 95 bodies were excavated from graves of Texas prison slaves murdered by the same lethal blunt force trauma to their skulls. Across Texas to this day, exist many unknown, uncovered mass graves of the remains of Mexicans, men, women and children, and other Indigenous ttaibes murdered as part of Texas's then "ethnic cleansing" practices for the extermination of all native populations as a result of various colonial wars, such as the so-called Texas War of Independnece, the U.S./ Mexican American War, and other war crimes committed by the notorious TEXAS RANGERS police army and other racist, vigilante groups, as enforcerss of colonial, rule. Without doubt, Texas' historical foundation, much like the body- politic of the U.S. and its prison industrial complex, all rest on colonial war crimes, genocide, plantation slavery, and tyranny. "Law" has always been used then and now, by the oppresor class as AN INSTRUMENT OF TYRANNY, as reflected in its "LAW WEST OF THE PECOS" saloon-court of tyrant judge ROY BEAN, to disenfranchise all Mexicans of citizenships theit: ranches, homes and properties and declare them PERSONAS NON-GRATA IN THEIR OWN HOMELAND, horrendous war crimes that have gone unpunished, without REPARATIONS to its victims. These Texas war crimes are glorified in its TEXAS PRISON MUSEUM in Huntsville, and "prisoniunits" are named after known racist, brutal and murderous "wardens, and prison directors, and other slave owners such as WALLACE PACK, GEORGE BETO, W. J. ESTELLE, and many more. PRISONS ARE BIG BUSINESS IN AMERIKKKA and communities of color are under siege by racist, capitalist laws, police, courts and its criminal justice system. More prisons, immigration detention centers, and racist violence along the U.S./MEXICO military bords are on the rise,
including the murders of innocent immigrant children detained" under horrendous conditions. THE RISE OF FASCISM HAS TAKEN ROO IN TEXAS, with a racist, right-wing political movement led by TEXAS GOVERNOR GREG ABBOTT, who is getting his "marching orders" by GRAND WIZARD IN-CHIEF DONALD J. TRUMP, to inflame the racist passions of white citizens that has emboldened racist persons to use racist violence as has happened in school shootings and other places of business targetinggall people of color. The anti-abortion, racist election laws, laws against transgender children, partens, racist immigra- tion laws, and cutting prison funds for essential basic needs for prisoners, to budget these racist, right-wing policies, and targeting "activists" who speak out inside and outside, such as the recent denial of parole to Chicano political prisoner XINACHILI, aka TX are prime examples of the rise of fascims in Texas. Only a people steeled in true history of the past, can serve to build consciousness, to resit any fascist psychology of social control and domination, by our realization that the power for change is in our hands, both inside and outside prison walls. Revolutionary-minded Texas prisoners are engaged in study groups, and in building prisone unity along all racisl lines, most feared by the prisoncrats. Many prisoners such as Xinachtli have served decades in consecutive solitary confinement under horrific racist and inhumane conditions in order to break their spirit and their will to resist. However, sheer oppression, repression has only served to solidify the TEXAS PRISON MOVEMENT with the political-class realities that only a social revolutionary change of the capitalist economic system and its dismantling can produce the needed changes to begin creating a new society, a new world where CAPITAL DOES NOT RULES as the system of capitalism neans nothing but more poverty, crime, racism, division of races/classes, human alienation and inequality, as WORKING CLASS LABOR POWER IS ENSLAVED BY THE FORCES OF "CAPITAL ACCUMULATION, " IN THE HANDS OF-THE RULINGS CLASS.

Second to California's, the Texas carceral state is the lagest in the nation, with its 'lindustrial empire" that reaps millions of millions of dollars sustained by forced prisoner slave labor. Prisoners sho refuse to work, without pay, or are outspoken suffer extreme forms of repression, including decades in solitary confinement, under inhumane conditions. INC V. BREUN, 142 S.CT. 2111 (20022), in challenge
to the UNCONSTITUTIONAL PRESUMPTION OF CRIMINAL CONDUCT AS INSTRUCTED THE JURY IN A SELF DEFENSE
CASE, where the petitioner was attacked by a
person with knife in hand and he pulled out his
gun [he had his gun as he was just coming off the
practice firing range and he and his girlfriend
had stopped (PT BLOCKBUSTERS to rent some videos,
and the confrontation ensueds in the store's
parking lot]. THIS GUY HAD NO PRIOR FELONY
CRIMINAL RECORD, but the jury was charged to
DISCOUNT HIS SELF DEFENSE PLEA BECAUSE HE WAS "UNLAWFULLY CARRYING A HANDGUN, " which now under
the BREUN DECISION was perfectly legal and "SERE
DEFENSE" and its historical analysis. PLUS, the
FIFTH CIRCUIT [one of the most conservative appeals
court] just ruled on FEBRUARY 2, 2023 APPLYING
BREUN to vacate the prisoners' sentence under
BREUN. Although that case is federal and applies
a federal statute, the same CONSTITUTIONAL PRINCIPLE
AND LOGIC would apply in that MY PROSPECTIVE CLIENT,
[if you will], HAD A HISTORICAL RIGHT# UNDER THE
SECOND AMENDMENT TO CARRY ON HIS PERSON A HANDGUN FOR SELF DEFENSE PURPOSES; AND TEXAS'S NEW LAWS ON
OPEN CARRY AND SOTON AND SO FORTH. HOWEVER, I cannot
get copies of his HABEAS WRIT, MEMO OF LAW because the mailroom here will censor it; THIS PRISONER,

AS DECEMBER 10 APPROACHES, I am suggesting to JLI, and all affiliated human rights groups interested in liberation, to consider staging a protest rally in front of the UNITED NATIONS BUILDING IN NEW YORK ON DEC, 10TH, 2022, INTERNAT'L HUMAN RIGHTS DAY, to bring to light, ongoing gross violations of human rights by the United States government, in the areas of maintaining racist, barbaric prisons in AMERICA'S PRISONHOUSES: protesting the race genocide of the U.S. criminal justice system of mass incarceration disproportionately represented by persons from the BLACK, CHICANO, LATINO, ASAIN, PUERTO RICAN, INDIGENOUS COLONIES OF COLOR, oppressed by colonialismimperialism; the arbitrary detention of hundreds of us, POW, POLITICAL PRISONERS IN THE USA imprisoned as "common criminals;" use of racist, prolonged solitary confinement as torture to punish socio-political dissent; maintaining modern-day prison slavery plantations via coerced slavery, and mainatining a double standard on human rights, all in violation of the various INTERNATIONAL HUMAN RIGHTS LAWS, STANDARDS, ACCORDS, INCLUDING THE NELSON MANDELA RULES.

New york University students from all the disciplines, i.e., law students, psychology, sociology, political science, criminal justice, departments couldbbe encouraged to take the lead, online, and organize it nationally and internationally around the world, also calling on other global human rights gigups to stage protests at their U.S. EMBASSIES in their own countries, in solidarity with our actions on DECEMBER 10TH. A keynote speaker could be selected, such as DAVID GILBERT, recently release political prisoner, and invite issued to other groups, such as THE JERICHO MOVEMENT, AMNESTY INTERNATIONAL, CENTER FOR CONSTITUTIONAL RIGHTS, COLUMBIA LAW SCHOOL. and the like.

The Certain Days: Freedom for Political Prisoners Calendar
is a joint fundraising and educational project between outside
organizers across North America and political prisoner
Xinachtli in Texas. We were happy
to welcome founding members and
(Rest in Power) home from prison in 2018, and founding
member home from prison in 2021. We work
from an anti-imperialist, anti-racist, anti-capitalist, feminist,
queer- and trans-liberationist position.
The calendar: Today's struggles for liberation, and against capitalism's permanent war, ecological destruction, and colonialism, are rooted in the history of earlier struggles for

Xinachtli (Nahuatl, meaning "seed")
is a community organizer and Chicano
movement revolutionary, currently
imprisoned in Texas. Formerly known
As , he worked
diligently in the barrio on civil and
human rights issues, and is known
widely for his legal skills. Xinachtli gained
international recognition as the national
coordinator of the Ricardo Aldape
Guerra Defense Committee, where he was instrumental in
helping to free Mexican national Aldape Guerra from Texas'
death row, where he had been framed for the murder of a
police officer.
In July 1996 Xinachtli was arrested after disarming
a sheriff who was attempting to shoot him. After defending
himself at trial, Xinachtli was sentenced to 50 years in
prison for aggravated assault, a charge he vehemently
denies. While imprisoned, Xinachtli continues to write
frequently, has helped to organize multiple prison strikes,
and has been held in solitary confinement for the last 20
years and counting. Xinachtli is a prolific jailhouse lawyer,
as referenced by Mumia Abu Jamal in his book Jailhouse
Lawyers: Prisoners Defending Prisoners v the USA. Xinachtli
assists many prisoners in seeking new trials and filing suits
against the repressive, inhumane Texas prison system. He
has been a frequent contributor to the Certain Days calendar
for many years, and joined as an inside collective member
in 2018.

Justice, including the mass movements of the 1960s and
70s. Many political prisoners and prisoners of war featured
in this calendar were organizers during that period: members
of the Black Panther Party or the American Indian Movement,
Puerto Ricans fighting for their homeland, or white anti-
racist allies working in solidarity with oppressed peoples.
Many of them have been in prison for 40 years or more. Even
more organizers have been locked up in the decades since.
Yet these prisoners are not relics of past movements. They
are still active in their political work. Despite the hardships
of organizing in prison, they continue to organize for justice
in the present day, behind bars, and on the streets. The
dates from movement history noted/commemorated in the
pages of this calendar serve to educate/remind us of that
rich and ongoing tradition of resistance. Given that prison
robs people of the ability to mark time - having access to
calendars was one of the demands of the 2011 California
prisoner hunger strike-creating a calendar that talks about
prisons is an act of resistance in and of itself. We hope our
work together on this calendar can act as a bridge between
our various contexts: inside and outside the prison walls,
the differing realities of the U.S. and Canadian states, and
between the movement generations.
For the first time since this calendar project
began our three founding collective members-
-are
no longer in prison. Combined, they served over 125 years
in New York state prisons for their political activism and
involvement in revolutionary organizations. We were happy
to welcome and home from prison
in 2018, and home in 2021. Sadly, passed
away in 2019, due in large part to the medical neglect he
endured while incarcerated.
According to, "I wanted to create a calendar that
would be supportive of political prisoners, but also serve as
a kind of repository or a reminder of important names and
important dates in our history. The hope was that it would
gain a special place in people's hearts in the community.
My sales pitch was always, 'If you don't have a Certain Days
calendar in your home or in your office or wherever you
happen to be hanging out, consider yourself a square.' And
nobody wants to be a square. I take great pride in being a
part of creating this calendar."

The right of a woman to an abortion did not depend on the Supreme Court decision in Roe v. Wade. It was won before that decision, all over the country, by grassroots agitation that forced states to recognize the right. If the American people, who by a great majority favor that right, insist on it, act on it, no Supreme Court decision can take it away.
The rights of working people of women, of Black people, have not depended on decisions of the courts. I submitted my responses to questionaire, which I hope is not misconstrued, but that is the "realities" of those of us, "prison organizers," (CHASE, id. ) , under a "position of war" from those who make it a livelihood of silencing us, censoring our "storytelling," and showing others our sacrifices, our legal and movement-oriented struggles against oppression, and a sure way out of our "dire social and racial condition" grounded on a history of white settler colonialism, white supremacy and the African slave trade, in the building of the AmeriKKKan empire. To ignore, or exclude the ugly history of what AmerikKKA has always been, as applied to the profession of "law" and scholarship, would do a great disservice to those who have sacrified their lives, their blood, and shed tears in our struggles to demand our human dignity and to not only interpet the world (Karl Marx), but to change it.

THE USA, City Lights, 2009, coming in the face of Texas prisons banning our "oral stories" included in RATTLING THE CAGES: ORAL HISTORIES OF NORTH AMERICAN POLTIICAL PRISONERS, AK Press, 2023, our "stories: of " .... law learned not in the ivory towers of mulibillion-dollar universities, ""IT IS LAW LEARNED IN THE BOWELS OF THE SLAVE SHIP, IN THE HIDDEN, DANK DUNGEONS OF AMERICA - the PRISONHOUSE OF NATIONS ... There has been a rise in government repression against political liberation movements and activists, such as the CRIMINALIZATION of the three members of the AFRICAN PEOPLE'S SOCIALIST PARTY and the UHURU MOVEMENT for speaking out against the US/NATION: proxy war against Russia and the war against Ukraine; the criminal indictment of 61 activists of the STOP COPYCITY MOVEMENT in Atlanta, Georgia, on racketeering charges (that included the police murder of activist MANUAL "TORTUGITA" TERAN, shot , 57 times by police) and the government's use of "letters from his diary" to support what the goverment says was Tortuguita's "hatred of police," and use to defend his murderers being "justified" in his assasssination; all as "domestic terrorism" anf the criminal charges against the TAMPA BAY 5 members of the STUDENTS FOR A DEMOACRATIC SOCIETY that were protesting racist policies of the University of South Florida, and the "cultural wars" sparked by the right wing on their moves to ban CRITICAL RACE THEORY from being taught at elementary and university institutions, and all the "political gerrymandering" moves and other racist voter suppression and other WOKE laws such as in Florida enacted by Governor Ron DeSantis, and on and on, are clear examples, we must nottgloss over, and be serious about our human rights work, that will for certain bring down the forces of poltiical repression even stronger against those of us, especially on the inside; AND OUR ONLY DEFENSE IS TO BEOME MORE VIGILANT, UNIFIED, AND CONNECTED IN ESTABLISHING OUR TIES AND MOVING FORWARD WITH OUR LEGAL AND POLITICAL HUMAN RIGHTS WORK. It would be "unprincipled" and not within the realms of reality, to think the true enemies of our freedom and liberation, will not raise their eyebrows, and their means at poltiical repression, when they learn of our "global justice movement" to raise consciousness and unitethe colonized world in other countries, where they have had a "stranglehold" on minds and hearts, by use of their imperiaalist cannons, knifes and bombs to keep those countries under their hegemonic rule and underdeveloped, as they can extract all the countries mineral resources, and control communities under a slave master versus slave condition. Once we "recognize" these historical realities, from movements that have preceded us, not only here domestically, butt in the history of the world and civilizations freeingy themselves from "colonial rule, " we would be in a better position to assess all integral ingridient of the DIALECTICAL PROCESS OF HUMAN TRANSSFORMATION AND EVOLUTION FROM THE STANDPOINT OF BEING CONSCIOUSE OF OUR TASKS AT HAND, AND MOVING FORWARD, WITH OUR EYES AND OUR HEARTS WIDE OPEN, OTHERWISE WE FALTTER AND FOLD AND OUR EFFORTS WILL AMOUNT TO NOTHING JUST "SPITTING IN THE WIND." There is no "time to waste," nor "games to play,' nor "feelings to get hurt."
Brings me to my previous "relation" with , I corresponded over sveral months, researching, writing, exchanging ideas and planning other scholarly works in academias, such as our future thesis we had been working on, titled THE PSYCHOLOGY OF DECOLONIZATION, to be submitted to a journal for publication. I spend hours and hours of research, writing drafts, re-doing them and engaging E in a series of "emails" related to all these themes, even engaging her students during this work. ALL OF A SUDDEN WITH NO EXPLANATION, REASON: OR RHYME, SHE ABANDONED OUR RELATIONSHIP AND DROPPED ME LIKE A "HOT POTATO. " She did mention that she was going through a "personal crisis" and I gave her time and space to resolve those personal, interpersonal matters. I stopped hearing from her, period, as she was on my registered "email" list. I send her a ton off emails that she should have on her emessage file folder, that should be turned over to so that I don't have to "spend" more time rectelling you those stories, so we can better understand each other. At no time was I ever disrepectful: towards her nor any of her ideas, nor personal prefences she openly revealed to me, such as which did not matter to me, of . But, I have moved on since then and embrace the "invite" you, PROPOSED AND WE MOVE FORWARD.
I have a number of ideas and other organizational topics I want to discuss with you, hopefully on email exchanges, or even over the phone line, but first you must get registered, which would be much speedier and easier for me to communicate with you:

I suggest you read LINDA HERRERA'S above-quoted book, of which I have a copy, and will be re-reading it again, and taking notes for a more detained discussion with you. A "digital outreach team" should be established and began introducting ourselves and our "dreams" to the colonized world, locally and worldwide, with a "global call" to join us. I will "dig out" some articles I had wititen years ago, on these matters, but are as highly relevant to these dicussions today, as the imperialist system that oppresses most of the peoples

Of course, many of my Ideas and suggestions are not "original ones" I created, but are suggestions, ideas, and thesis I learned in my studies, and I don't want to be accused of being a "plagiarist" or engaging in plagiarism, and will give credite where credit is due.
By the way, EMESE IILYES finally emailed me yesterday, after a long, unexplained absence, as I related to you, really disappointing to me, because in these "relationships" of correspondence, we must be respectful of each other, nor overly exagerate expectations, and develop < avenues of trust and solidarity, and not merely act as "dull scholars in academia, " without understanding our "feeling the spiritual connection to these liberation movements and history" many of us on the inside, know no other "escapism" but to embrase the "realities" we, as incarcerated peoples under llock and key, find ourselves in, working towards transforming our brothers, and sisters to break the chains that make us all slaves of the state, and create, and embrace a "new ethic"of collective community care, unity, love, solidatity, and revolutionary praxis, as feminist, activist BOCAGOKS speaksw about in her books and thesis. Emese tells me that our "joint co-authored" abstract was voted in and we have been invited to submite a more comprehensive manuscript for publishing. Although I was, and still am, disapointed at Eemes, for her abandoning me, I will raise these concerns to her in a respectful way, understanding that sometimes our "interpersonal problems" interferre with our work but we must learn how to defeat those persnal problems for the better of humanity.
