I’m a “Jailhouse Lawyer”
Here at TRCI I’m serving a “de facto”
life without parole for non homicide
related cases, I’ve been striving to
become educated in Civil Rights law despite
the hurdles of prison for about 6 years now,
I focus on Medical and Mental Health
issues, I have fought pro se Emery v Premo
Et al U.S.D.C. (District of Or) 6:15 cv-01227-51 and
ended up with Pro Bono counsel and settled out
of court for sixty two thousand dollars and change
then used some of that money to file Emery
v. Franke et all U.S.D.C. 2:18-CV-00257-SB and
settled that case for 40,000.00, and am now
fighting Emery v. Nooth et al, U.S.D.C. 2:18-CV-02096-MC
and intend to hire an attorney
after the initial filings. Ive filed several
other 1983’s and writs of Habeas Corpus on
behalf of other inmate’s. all of this I have
done with 3 books, “The Prisoners self help
Litigation Manual,” “Protecting your Health
and Safety,” and “The Jailhouse Lawyers
Handbook.” Our so called “Legal Library”
is virtually useless here at [Redacted] The “Legal
Aides” are prohibited from helping anyone
do anything, “The Legal Librarians” actively
enforce Rules to prohibit, and hinder inmates
abilities to file suits, small claims, etc.
The main Library (we now have two for
the two halves of the Institution,) here is

approximately 4 feet wide and 25 feet long
[or so] the word processors and research
computers are so crammed together they are
literally about 2 inches apart leaving no room
for writing notes etc. Alot of ODOC's inmates
are diagnosed Severely Mentally ill, [as aM
I} and simply dont understand how to use
the word processors or computers, there is
an inmate assigned to help with this but
he’s ineffective for all intents and purposes,
I do not even bother trying to use
the legal library and Most everyone else
knows not to bother as well. When you
do need to go for copies, etc it takes
forever to be called down there, usually
more than a week. There is nobody to
help the deaf in this library, For those
who do use it they arent allowed enough
time or access to it! TRCI is hands
down the worst legal library you can
imagine and it is by design that way
by the Legal Librarians, we are charged
For many blank Forms, we are not
allowed to copy thing like Grievances etc
unless we ahve money on our account,
they will not debit our account even IF
its for Exhibits in a case. we “had”
typewriters, on our units until recently
so now Im reduced to handwriting
everything! Im not legally allowed to

help anyone here, but do anyway!
our legal library hours are Mon-Thurs
8:00AM-10:30AM and 100 to 345 PM,
then FRI, 800-1030AM and 100-200PM
There is nothing any inmate can
do about this because TRCI is located in
"the boonies" far from any real oversight,
so the staff stick together, they lie in
Grievances about this and in court, and
the courts out here stick with the prison.
all of our books are outdated, the only
updated inFo we have is limited access to
LEXIS NEXIS, No forms or books for small
Claims other than a basic Notice of Tort
claim, is there any assistance you can
offer us here to get a proper/ legal
Law Library? Also I am in contact
with Oregon Cure trying to force all ODOC
staff to wear “bodycameras” to [scribbled out word] stop a lot
of the abuse here, florida could use them
as well from what i read about their
prisons, perhaps you could think about
that, some argue we’d lose too much
privacy, but “privacy” in prison is exactly
what the guards use to abuse, rape, and
kill with impunity. Thank you and

Dear JLI,
I am a Guild Member here
in Oregon at Two Rivers Correctional Institution.
I am writing in regards
to your article in the Spring/Summer 2019
issue of Guild Notes, pg.17 pertaining to
Legal Libraries.
I/we have real and serious problems with
our legal library, specifically The legal
Librarian “Ms [Redacted]” She institutes
Rules & Regulations that are designed to
deter and or interfer with our access to
the courts. For example the “legal aides”
are their mainly to pass our books and
blank forms, and only answer generic
questions, they are not allowed to provide
any real substantive, hands on help.
The legal library is not handicap friendly,
its a very small, tight, narrow hallways
with word processors literally side by side
separated by 1-2 inches, there is no room
to take notes, or even sit draft documents
to type up. To use a flashdrive you first
have to sign a waiver giving her permission
to read your Legal work.
I am diagnosed severely Mentally Illl,
i.e. Major Depression, ADHD, Anxiety, etc.

and so these tight, confined, noisy
spaces prohibit me from using this
library, I’ve basically bought my own !
I have a discrimination complaint
pending over this issue.
Just the other day Ms [Redacted] refused to photo
copy an Investigative Report by Disability
Rights Oreggon at my own cost,
This Report is Public Record and permission
is given by DRO to photocopy this Report.
This Report is a scathing indicment
of ODOC Medical and Mental Health
System and is needed as evidence in
My two pending 1983 civil rights
compalins in the U.S.D.C. Emery v. Nooth et al.
#2:19-cv-01070-AC and 2:18-CV-02096-AC
which are for denial of
adequate access to Medical and
mental health services. I filed
complaints of Censorship and denial of
access to a law library and or its
resource’s against Ms [Redacted] but no
action will be taken against her as
TRCI is in the so called “backwoods”
far from scrutiny and ran by a
“good ol boy network,”
I will of course pursue this in court

once the complaints have been exhausted,
I am hoping that you can lend
Some help here as Im Sure you are
aware of the difficulties in taking on
a prisons Legal Library system.
If not you, perhaps you know of a
Lawyer that would help?
We also do not have adequate law
books, forms, supplies, photocopying,
the inadequacies run’s the entire gamvt.
This is all done purposefully by MS [Redacted]
in order to act as a gatekeeper to
the courts, I cannot even type
legal documents anymore because of
her, they all are now handwritten.
Anyway, any help you could offer is
greatly needed and would be
appreciated by all of us, even the
“legal aides.” Thank you.

and have 39 to go, IM 53 yrs old

First let me say that yes I would like

Preferably civil rights - ADA Studies
as this is my main focus of law.
I have a case pending in the U.S.D.C [Dist. of Or] right now, Emery v. ODOC et al #2:22-CV-01977-MC for cruel & unusual punishment i.e. leaving bright lights on 24/7 in violation of established law.
Can you provide an Amicus Brief to me
in this case ? I am prose and so
need as Much professional documentation
on the harm of constant Illumination
that I can get ?
